Introduction:
Welcome to Thrive Digital Design, herein referred to as Thrive, a local business committed to innovating African web experiences and crafting brands that authentically reflect the visions of their creators.
Services Offered:
Thrive provides specialized services in User Interface & User Experience design, web development, brand identity, logo design, print design, and digital illustrations/product design.
Payment Terms:
- All clients are entitled to one free initial meeting
- Project costs are calculated hourly
- Project payments are individually agreed upon before the commencement of work.
- Payments are due by the agreed-upon date. A late fee of R100 per day will be charged for overdue payments.
- All payments are processed electronically through Payfast or EFT.
- Recurring payments can be cancelled at any time, provided cancellation is made before the start of the new month.
- Failure to pay the agreed-upon amount grants Thrive the right to withhold product rights and remove it from all platforms until payment is completed.
Intellectual Property:
- Once full payment is received, clients will have full ownership of the product and all associated rights.
- Thrive requests the right to showcase the product in our portfolio or on social platforms with the client's permission.
Client Responsibilities:
- Clients must provide all necessary information for project completion.
- Clients are responsible for contacting Thrive during working hours. Weekend or after-hours work incurs a double charge.
Project Timelines:
- Timelines are agreed upon with project payment.
- Priority fees apply for clients seeking to streamline the deadline.
- Thrive is not responsible for delays caused by external factors.
Revisions and Iterations:
- Hourly charges apply for post-approval changes.
- Clients purchasing a website receive one free revision of content and images upon completion. This however does not apply if this causes structural changes that will lead to us revisiting the design phase, in that circumstance changes are charged hourly.
Cancellation/Refund Policy & Termination of Services:
- If a project is cancelled after initiation, clients must pay for the hours of work that has already been completed.
- Strictly, no refunds are issued for finalized projects.
- Services can be cancelled at any time, with payment for the current month required before cancellation.
Confidentiality:
- Client information is kept confidential unless permission is granted for portfolio showcase.
- Thrive requests the right to showcase the product in our portfolio or on social platforms with the client's permission.
Liability:
Thrive is not liable for issues caused by external factors or companies.
Dispute Resolution:
Disputes will be settled through arbitration.
Governing Law:
These terms and conditions are governed by the South African legal system.
Updates to Terms:
- Terms and conditions are subject to change at Thrive’s discretion.
- Any updates to Terms and Conditions will be communicated to clients via email.
